Terms of contract

The contract terms form the basis for regulating the relationship established between the company Travel Group, whose legal name is Grupo TG Tours SL (hereinafter referred to as Travel Group or “agency or company”), as the organizer of the trip. The company is located at Avenida Antonio Dominguez, 5, 4.11, Playa las Americas, Arona 38660 Santa Cruz de Tenerife CIF: B72454473, registered in the Trade Registry of Tenerife under number 2022/2015, and the individual, hereinafter referred to as “client or traveler”, who accesses the page for information and subsequent booking through the website www.tg.tours.

Basic services

The mission of Travel Group is to organize tourist services, form groups of travelers, offer itineraries, and provide consultation on the trip and stay. Travel Group’s goal is to adapt the journey to the group, not the group to the journey. Life is more flexible, intimate, and adventurous than tour operator packages. Each of our travelers is an active part of the trip. The client, when booking a trip, must understand and accept the philosophy of these trips, be flexible, and open to adventures.

The company selects a tour leader who accompanies the group during the tour. Our tour leaders are experienced adventure travelers with language skills, decisive, and with social and group management skills. The tour leader’s task is to support the group in logistical matters to ensure the trip runs smoothly. However, the tour leader is not a professional or licensed guide and does not possess exhaustive knowledge of history, monuments, nature, or any other skills limited to professional guides.

The tasks of the tour leader during the trip include coordinating and assisting the group, having the ability to make decisions that affect the route, and even changing it based on their travel experience and the information provided in the trip report by the Company.

For those tourist services that are not included in the tours organized by Travel Group and which will be requested by clients additionally, the tour leader will be responsible for guiding and offering various options for services (transportation and activities) that will be reserved. The tour leader shares their knowledge to enrich the travel experience.

The tour leader will make decisions, as far as possible, in any unforeseen circumstances that may arise during the trip, not dependent on the agency, provide support to the traveler in case of any problem or unusual circumstances during the trip, and act as an intermediary in case of conflicts between group members.

The tour leader is a figure responsible for coordinating the group’s opinions and having the final say in case of a lack of consensus in the group. Significant changes to the itinerary must be unanimously agreed upon by the group.

The coordinator acts as a liaison between the client and Travel Group during the trip.

Under no circumstances will the tour leader engage in tasks such as individual guidance or special attention that go beyond the duties specified in this document.

The tour leader will meet the group at the point of arrival and accompany the group until the end of the trip.

In the “Cost” section of each tour page, all included services are listed. In general, the cost of the combined trip includes:

  • A route designed by Travel Group, with major attractions in the country’s area. However, Travel Group is not responsible for changes that need to be made to the route (before or during the trip) due to force majeure circumstances such as weather, strikes, customs difficulties, border closures, illness, mechanical failures, flight cancellations, or any other unforeseen circumstances.

  • Assistance throughout the trip from a tour leader, a Travel Group employee who is responsible for providing or assisting in the provision of necessary components for the trip.

  • All accommodation and transportation between islands.

  • Tour insurance.

  • Transfers and car rental, if this service is included in the contractual program.

  • Activities not listed in the Travel Group website’s itinerary, such as additional activities that require the presence of a tour leader and may result in an increase in the initial budget, will be covered by travelers.

The cost of the trip does not include “additional services,” such as tips, coffee, wine, liqueurs, mineral water, special diets – even in the case of full board or half board, unless explicitly stated in the contract, except for additional hotel services, and typically any other service that is not explicitly stated in the “included in the cost of the package” section or specified in the program/offer, in the contract, or in the documentation provided to the customer upon signing.

In the event of purchasing excursions or additional trips not organized by Travel Group, please note that they are not part of the contract, and the company cannot be held responsible for their conduct or cost.

Performance of the contract

This contract is considered concluded upon the consent of both the agency and the client. The client declares that he/she is of legal age and has the necessary legal capacity to enter into a contract for services offered online, in accordance with the terms described in detail below, which he/she understands and accepts.

Before making a reservation through the website www.tg.tours, the client will be required to accept, by checking the acceptance box, the general terms of the contract, which affect the management of the services offered. Otherwise, the trip reservation will not be accepted.

It is understood that the consent was given by the company when it confirms by email the client’s reservation acceptance and the receipt of the payment amount for the reservation.

The client will give his/her consent through the website www.tg.tours.

The service provided is the trip or trips described in the reservation confirmation.

DUTIES AND RESPONSIBILITIES OF THE CLIENT

  1. Deposit.

If you book a trip 30 days or more before the departure date, you can pay in two installments: one for the booking amount of 50% of the total cost, and the other for the remaining 50% of the total cost 30 days before the departure date. If you book a trip less than 30 days before the departure date, you must fully pay for the trip. Once payment is confirmed by Travel Group, the company will have 24-48 business hours to confirm receipt of payment by email and confirm whether there is space on the trip for the customer, in addition to informing whether there is a minimum number of travelers available to confirm the departure of the trip, or conversely, not enough registered, and in this case, Travel Group must notify the customer no later than 30 days before the departure of an intercontinental trip, 21 days before a trip to Europe, and 15 days before a trip within the country.

  1. Providing Information.

The data provided must be accurate and complete with full names. The client is solely responsible for the accuracy and correctness of the data provided to Travel Group during the booking process. Any errors in the name or any other data provided by the client that result in expenses for ticket reissuance, visa issues at customs, or any other related problems will be borne by the client. If any additional information is required, such as a copy of the passport, etc., it must be provided to the company. If the client fails to provide all their data thirty days prior to the departure date, an automatic penalty of 50 euros will be charged for additional expenses or costs incurred by such behavior. The client’s data that must be provided includes passport number, copy of passport data and medical card (if applicable), full name, date of birth, and nationality. The email provided by the client must be truthful and regularly used by the client, as it will be the primary means of communication between the agency and the client. The client is responsible for adding the email address info@tg.tours to their contacts to ensure that messages from Travel Group do not go to their “spam” folder. Individuals with disabilities must inform the agency of their situation before making a booking request to assess the possibility and feasibility of entering into a travel contract in accordance with their characteristics. According to EU Regulation 1107/2006, a person with reduced mobility means any person whose mobility is reduced due to physical deficiencies (sensory or motor), permanent or temporary disability, mental disability, or any other disability or age-related reason, and whose situation requires adequate attention and adaptation to their specific needs of the service provided to other participants in the trip. In any case and based on objective medical reasons, Travel Group reserves the right to refuse to accept an offer made to the client based on a report provided by the client.

  1. Payments.

3.1 Payment Methods.

The customer can make payments for bookings and other expenses via bank transfer or debit card.

3.2 Payment Schedule.

After confirmation from Travel Group, acceptance of the booking by the customer, and receipt of payment for the booking, the customer must complete payment of the specified price by the departure date according to the following schedule:

If you book a trip 30 or more days before the departure date, you can make two payments: one for the booking in the amount of 50% of the total, and the other for the remaining 50% of the total 30 days before departure. If you book a trip less than 30 days before the departure date, you must pay the full amount.

In case of non-payment of the amounts that may be pending in each case, Travel Group reserves the right to cancel the booking, and the customer will lose the booking amount plus other expenses already incurred, such as plane tickets, insurance, trains, visas, etc.

The prices offered on our website www.tg.tours are based on the cost of airline tickets, exchange rates, and costs in effect at the time of publication on the website.

Travel Group reserves the right to change these prices for new bookings if the indicators change significantly.

Travel Group reserves the right to set price increases no later than 45 days before the departure date due to unforeseen and unfavorable changes such as fluctuations in exchange rates, increased airline ticket costs, or other transportation expenses, taxes, etc.

If the establishment of these additional expenses results in an increase in price of more than 5% of the total amount, excluding travel insurance costs, the customer may cancel the booking within 10 days of being notified of the price increase and receive a full refund. However, if the customer makes a booking, the trip price will be guaranteed with a deposit, unless one of the cases established in the previous sections occurs.

  1. Compliance with the rules of the destination country and following the instructions of the tour leader during the trip.

At any time, the tour leader’s decision on issues where there is no consensus will be final in all matters, in order to guarantee the safety and smooth operation of the trip. Booking with Travel Group implies that the client agrees to submit to the authority of the tour leader and will comply with their instructions for the good development of the trip. The client must strictly comply with the laws, customs, foreign policy, and drug regulations of the countries visited. In the event that the client fails to notify the tour leader of any such action or engages in any unlawful act that may create danger or discomfort for other members of the group, the company may settle the relationship between the client and the latter, without giving rise to any rights of demand or refund to the client, leaving any actions and/or claims that other travelers may wish to take against the violator of the trip rules.

  1. Obligations regarding documentation.

The client must have a valid passport for entry and exit from the country or countries of destination throughout the entire travel itinerary, as well as any visas, permits, and certificates, including vaccination certificates, and mandatory insurance. It is the exclusive responsibility of the client to obtain the necessary documents, permits, certificates, etc., and to maintain their validity and suitability throughout the trip, and the client is responsible for any damage that may arise from failure to comply with the provisions of this paragraph. The truthfulness and/or accuracy, whether voluntary or involuntary, of the information that the client provides to the company will be the exclusive responsibility of the latter, as well as for all subsequent consequences for booking tickets, concluding insurance contracts, or obtaining visas that are generated. Any information or notification provided by the company regarding visas, vaccinations, weather, clothing, luggage, etc. is approximate and provided to the client as a courtesy, so the client is responsible for any errors or omissions in the information provided.

  1. Responsibilities related to public transportation and rental cars.

Public transportation: due to the nature of Travel Group’s trips, the group will be traveling on local public transportation. These trips are not included in the Travel Group’s tour package and are not pre-arranged unless otherwise specified, and each group decides for themselves what mode of transportation to use. The traveler agrees that Travel Group is not responsible for the selection of service providers, quality, safety, and any civil, administrative, or criminal liability arising from their improper use by the client or driver if they are a third party.

Rental cars: for trips that are specified on the website for each trip, the cost of these vehicles is usually included in the trip. Travel Group will be the one reserving rental cars to facilitate the rental of these cars. Travel Group will choose the tour leader of the trip as the driver, and if more drivers are needed, travelers will voluntarily participate in the trip. Rental car companies require the driver of the vehicle to provide a credit card as a deposit. Each member of the group is jointly responsible for equal shares of the total amount of additional expenses (fines, accidents, or additional expenses) that may arise during the trip. Certain additional expenses are charged to the driver’s card after returning the rental car at the end of the trip. For this reason, Travel Group may request a deposit of 100 euros from each client to cover possible extraordinary expenses and use this deposit to pay the amount in favor of the injured driver. Within 15 days after the end of the trip, Travel Group will return the deposit paid by each client in full if there were no additional expenses or the corresponding balance if there were additional expenses. In the event that there are no drivers willing to operate the rental car on the planned route, Travel Group may cancel the trip with a full refund of the amount paid by the client. In the event that there are not enough drivers for all the cars required for the trip, clients who offered themselves as drivers have priority in the trip with subsequent registration order in the trip.

CANCELLATIONS AND CHANGES

If you want to cancel a purchased trip, you must notify Travel Group by email at info@tg.tours or in writing to the company address listed on their website, www.tg.tours. In case of email communication, confirmation of receipt by the agency is mandatory. The date of receipt of the letter or confirmation of receipt of the email by the company will determine the cancellation fee that will be applied. The cancellation fee is expressed as a percentage of the total cost of the trip as follows: If the cancellation is made within 60 days prior to the departure of the trip (for an unconfirmed trip), the tourist is entitled to a refund of 90% of the total trip amount, which is only refundable in case of full payment of the trip. In case of non-payment, a 100% prepayment will be refunded minus a 10% cancellation penalty. In case of cancellation of a “confirmed” trip, you have the right to a refund of the cost of the main booking according to the following conditions: if the tourist refuses the tour within the period from 30 to 15 days before the tour starts, the funds paid according to the Travel Group invoice will be returned to the client with a 50% penalty deduction from the trip cost, and if the tourist refuses the tour within 14 days before the tour starts, the funds paid according to the Travel Group invoice will be withheld as a 100% penalty deduction from the trip cost, unless otherwise agreed upon by the parties. Regardless of the above, and especially with regard to tickets for planes, trains, ships, or any other means of transportation, the company does not guarantee a refund of any previously issued sum, and the traveler must comply with the rules established by each type of transport company (most previously issued airline tickets do not allow changes or cancellations), provided that the ticket was issued and paid for at the time of cancellation of the trip.

In case the trip is regulated by special economic contractual conditions, such as charter flights, ships, special rates, etc., cancellation expenses due to refusal will be established in accordance with the conditions agreed upon between the parties. If the agency or tour leader has made advance payments for hotel rentals, events, or car rentals, and these payments are part of the budget provided to the traveler, if the client cancels the trip within the last month before departure and until your place is not taken by another traveler, you must pay the corresponding portion of these expenses to avoid penalizing your fellow travelers with your cancellation.

In addition, the specified surcharges should include expenses for any cancellation option provided for in the contract.

Company note: During booking, you can add a cancellation option to your travel expenses, which guarantees you the ability to cancel the trip under certain circumstances.

Changing the trip

All changes to trips must be requested by email to info@tg.tours. They are subject to approval by the company and have a management fee of 50 euros. In case of a trip change, some clauses of the tourist contract may be modified by email, and new conditions will be sent in advance for the client to accept before the change takes effect.

Change of face

In case you are unable to make the trip and need to cancel the reservation, all name changes must be requested by email at info@tg.tours. The requested change is subject to the company’s approval and requires a management fee of 50 euros. In order to be accepted, the person taking the reservation must meet the age and gender characteristics required for the specified trip. For example, if the reserved seat is intended for a girl, she must be replaced by another girl who falls within the required age range for the trip. If there is a service that is contracted under a personal name and cannot be transferred to another person, such as flights or internal transfers, it must be paid as an additional expense to effectively change the traveler.

Data reservation

When booking a trip, the traveler enters their full name and surname as stated in their official documents: this name will be used for the continuation of the purchase of tourist services and insurance. If the name does not match the name in the official documents, the company bears no responsibility.

Cancellation by the company

The company reserves the right to cancel intercontinental trips within the last 30 days before departure, 21 days before a trip within Europe, and 15 days before a trip within the country. In case of cancellation due to lack of clients to fill the minimum group, we will provide an opportunity to change the trip for free, a 100% bonus from the paid amount that can be used in any of our trips within one year or a full refund of the amount paid by the client. In case of cancellation of the trip by the agency, including due to force majeure circumstances such as health crises, border closures, state of emergency, the client can choose between a full refund of the amount paid or choose another trip from the agency’s offerings. If the alternative trip offered by the agency is cheaper than the originally booked trip, the difference will be refunded to the client. If the alternative trip has a higher cost, the client must pay the difference. The agency is not obliged to compensate for damages in the following cases: when the cancellation is due to the fact that the number of people registered for the trip is less than the required number, and the client is notified in writing. In this case, the agency is only obliged to fully refund the client’s paid trip reservation. Unused services, discounts, and refunds for loss or non-use of services due to voluntary or forced termination of the trip, such as illness, death of a family member, etc., are not provided. Travel Group trips are closed packages, and in case the client cannot use any of the services, such as a flight, a night at a hotel, etc., 100% of the booking must be paid in the same way. The company reserves the right to cancel a traveler’s booking if the traveler exceeds the deadline of 30 days before the trip to make the second payment. The mentioned cancellation will be communicated via email.

Flexibility

The client acknowledges and accepts that due to Travel Group’s philosophy and the nature of this type of travel, its configuration and development require flexibility, so the client must allow for alternatives during the execution and/or preparation of trips that are accurate. The itinerary proposed for each trip is merely representative of the intended activities, and the company will not have contractual obligations to faithfully follow it. It is understood that routes, programs, itineraries, activities, accommodations, and transportation may be changed without prior notice due to local circumstances or events, which may include illness or mechanical failure, flight cancellation, strike, customs difficulties, weather, and any other unpredictable circumstances.

CHANGES MADE BY THE COMPANY

The client understands and accepts that due to the philosophy of Travel Group, the nature, configuration, and development of this type of trip requires flexibility, and therefore, the client must allow for alternatives during the execution and/or preparation of the trips that may be accurate. The route proposed for each trip is merely representative of the expected activities, and the company will not have any contractual obligations to faithfully follow it. It is understood that routes, itineraries, activities, accommodations, and transportation may be subject to change without prior notice due to local circumstances or events, which may include illness or mechanical failure, flight cancellation, strike, customs difficulties, weather, and any other unforeseeable circumstances.

The company reserves the right to change the services or prices described in our travel catalog or on the website www.tg.tours in any other way before booking. The company will ensure that all travelers registered for one trip use the same plane to move around the country. However, the agency can guarantee this assumption only for travelers who have registered at the time of trip confirmation. Any traveler who registers after trip confirmation will depend on the availability of seats on the plane at the time of the second payment. In this case, the agency reserves the right to increase the cost of the trip if the airline seat has a higher cost than that which was at the time of trip confirmation or to offer an alternative flight different from that used by the other registered travelers before the trip was confirmed. In the case where the cost of the trip includes train or ferry rides, if such a change is made and the client already has a company offer, they will be informed at the time of booking. Generally, the company keeps trip information according to advertising, although changes to the route may be made as necessary or at the company’s recommendation. If significant changes are made, the company will inform the client as soon as possible before departure. A significant change is understood to mean a change that affects more than 1 in every 5 days of travel. If this change is due to force majeure or unforeseeable circumstances, no compensation rights will be granted. In other cases, the client will have the right to choose between accepting the change, requesting cancellation and refund of paid amounts, or accepting an alternative travel proposal. The company reserves the right to join two groups to the same destination and on the same dates if there are two different age groups, and it is necessary to make both trips.

BOOKING AN APPOINTMENT

Denial of reservation and exclusion from the trip may occur for those who:

  • Disrespect fellow travelers, companions or drivers, as well as other staff or escorts, such as hotel receptionists, waiters, etc.
  • Act cruelly or aggressively (verbally or physically).
  • Repeatedly violate punctuality.
  • Do not pay personal expenses or steal things from hotels and restaurants.
  • Carry weapons or similar items.
  • Wear clothing or symbols that incite violence, racism, or xenophobia.
  • Do not follow the instructions of the tour leader and endanger their own safety and the safety of the group.

 

Violation of these rules will result in the traveler’s removal from the current trip and denial of booking for future trips. Considering the specific nature of trips organized by Travel Group, no travel agreement will be issued to registered individuals who may harm economic, commercial, corporate, and any other interests similar in nature to Travel Group, as they are owners and/or employees of companies whose business and/or economic activity is similar to that of Travel Group. Considering the nature of trips organized by Travel Group, it reserves the right to ask its potential participants to fill out a form so that Travel Group can assess their suitability for participation in a specific event.

COMPANY LIABILITY, RISKS AND INSURANCE

Despite all the attention paid to checking the contents of the website www.tg.tours, the company is not responsible for possible errors or unintended omissions. The client understands that the nature of the trip involves adventure and may be associated with significant personal risk. The client assumes this risk and waives any claims against the company for damage or even death arising from this inherent risk. The client knows that in certain places and under certain circumstances, they will be visiting places where political, cultural, and geographical conditions may pose certain risks, dangers, or physical demands that exceed those that may arise in their everyday life. The client knows and declares that they have at least considered and weighed the potential risks, dangers, and challenges and unequivocally assumes the risk associated with the trip they intend to take. The client is responsible for dealing with customs, weather conditions, physical problems, and applicable laws at every moment of the route, and of course, they have the opportunity to inform themselves in advance and contact the local embassy or consulate of each destination.The company is not liable for death, bodily injury, illness, or any other losses affecting the person and/or property of the client, or for the company’s inability to sell, perform, and/or complete any task due to the client’s death, bodily injury (including emotional trauma), illness, or any other damage caused by natural disasters, war, terrorist attacks, civil unrest, government actions, political unrest in any form and in any place, or any circumstance that may occur beyond the company’s reasonable control. The company is not liable if the defects discovered during contract performance are related to the client. The company will not be liable if these defects are related to a third party unrelated to the services provided under the contract and are unpredictable or insurmountable in nature. If these defects are related to an event that the company, despite all necessary efforts, could not foresee or overcome, neither the company nor the coordinator is required to accompany the client at the beginning and/or end of the trip, which means the physical presence of the coordinator on the outbound and/or return flight. The duty to provide assistance by the organizing agency: the organizing agency, despite being released from liability, will still be obliged to provide necessary assistance to the consumer in difficulty. The duty to provide assistance provided in the preceding section does not apply if the defects arising during the contract’s performance are exclusively related to the intentional or negligent conduct of the consumer.

SECURITY

The company provides the client with a minimum coverage travel insurance as specified in the terms and conditions provided to the client at the time of booking. The company always recommends additional insurance coverage for cases of cancellation, loss of property, or any other damages that may arise as a result of loss, damage, delay, or any other inconvenience to the client. The company notes that risky activities such as scuba diving, caving, aerial sports in general, and adventure sports such as rafting, bungee jumping, hydrospeed, canyoning, and the like, as well as rescuing people at sea, in the mountains, and in the desert, are not included in the contractual medical guarantees. In the event that the traveler wishes to engage in any of these activities, the traveler is solely responsible for entering into an insurance agreement with the company that provides such services. When entering into a travel contract, the client has the option to purchase cancellation insurance to cover any possible cancellation by the client due to any of the events covered in the specified insurance policy. The mentioned insurance can only be purchased at the time of booking the trip and cannot be added as an additional service after booking. In cases where the client purchases this cancellation insurance, it will only take effect when the trip is confirmed to begin.The insurance will be activated at the time of confirmation of the trip. In cases where the client arranges a trip with a confirmed departure, this cancellation insurance will take effect 72 hours after the client concludes the travel contract. When the client arranges another private insurance with higher coverage, they should be aware that the cost of Travel Group insurance is part of the travel cost without the possibility of reducing the stated amount, and therefore, the client will receive external insurance for an additional fee. In this case, the client must ensure that the insurer is aware of the nature of the upcoming trip. Travel Group does not pay attention to decisions made by the insurance company regarding incidents reported by the traveler and is not responsible for these decisions. Processing of a claim in the insurance company is exclusively carried out by the client, leaving Travel Group completely out of this process.

CLAIMS AND DEMANDS

If a client has a complaint or claim against the company, the client must first inform the tour leader during the trip to address the reason for the complaint. If an agreement is still not reached, a new complaint must be submitted in writing to the company within 10 days after the end of the trip. The company is not responsible for claims received after this period.

SUPPLIER TERMS AND CONDITIONS

Airlines, trains, cruise lines, and any other service providers have their own booking and transportation conditions, and each traveler will be subject to these conditions. Some of these conditions may limit or exclude liability in favor of the transport company and fall under the scope of various international conventions. For air travel, check-in at the airport will be made no later than 3 hours before the official departure time, and in any case, specific recommendations indicated in the travel documentation provided upon signing the contract will be strictly followed. The client is recommended to confirm the flight departure time 48 hours in advance. Service providers, each within their respective obligations, will be responsible to the client for compliance with the obligations arising from the applicable sales rules and conditions of each of the products and services or package tours that are contracted, while Travel Group assumes no obligations or responsibilities for those products or services that it does not directly provide.

TRANSFER OF RIGHTS TO THE IMAGE

Thus, when purchasing a combined trip, by accepting the terms and conditions, the user grants Travel Group the right to use, distribute, reproduce, process, modify, publish, make available to the public, transmit, in any type of analog, electronic, computer and/or digital media (including, for example, air, cable, satellite, internet transmission systems, even on social network pages, such as, for example: Facebook®, Instagram®, Twitter®, YouTube®): your own portrait and image contained in the videos and images that may be taken during the purchased trip (hereinafter “Images”). The user also: transfers all rights of any type and nature existing in the Images, necessary for the commercial, advertising, and promotional use of the Images; expressly states that they have no claims for any reason or right (e.g., economic) against Travel Group, its successors and/or assigns, and/or in general, any person who uses and exploits the Images; guarantees Travel Group the unobstructed use of all rights transferred under this article and hereby indemnifies and holds Travel Group and/or its successors harmless from any and all actions and/or claims of third parties regarding the Images and their use, assuming all related obligations.

LAW AND APPLICABLE JURISDICTION

This combined travel contract is governed by what has been agreed between the parties and what is established in these general conditions, and in their absence – the provisions of Royal Legislative Decree 1/2007 of November 16, approving the Consolidated Text of the General Law for the Defense of Consumers and Users and other additional Spanish laws. Any dispute regarding the interpretation or application of these general conditions will be resolved by Spanish courts in accordance with the rules applicable to consumers and users, without prejudice to the fact that the consumer and user may submit their complaint using other mechanisms provided by special legislation.

PRIVACY POLICY

You can review our data protection policy in the official notice and Privacy Policy on our website www.tg.tours, which you must accept along with these General Conditions when submitting the information form and booking request.
